Terms of Service

1. Acceptance of Terms

By accessing or using Klyp (“the Service”), operated at klyp.social, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Klyp is an AI-powered video content intelligence platform that analyzes short-form video trends across TikTok, Instagram Reels, and YouTube Shorts. The Service provides trend analysis, content recommendations, hook and script generation, competitor insights, and video analysis tools for content creators.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent.

4. Video Uploads & Content

When you upload videos or provide video content to Klyp for analysis:

• You agree that uploaded videos will be stored and retained by Klyp on our servers for analysis, service improvement, and model training purposes.
• You retain ownership of any content you upload, but you grant Klyp a non-exclusive, worldwide, royalty-free license to use, store, process, analyze, and create derivative works from your uploaded content for the purpose of operating and improving the Service.
• You represent and warrant that you own or have the necessary rights and permissions to upload and share the content, and that your content does not infringe on any third party’s intellectual property or other rights.
• You may request deletion of your uploaded videos by contacting contact@sentiments.ch. We will process deletion requests within 30 days, though derivative data (such as anonymized analysis results) may be retained.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Violate any applicable laws, regulations, or third-party rights
• Upload content that infringes on copyrights, trademarks, or other intellectual property rights
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service to send spam, unsolicited communications, or misleading content
• Reverse-engineer, decompile, or disassemble any part of the Service
• Scrape, crawl, or use automated means to access the Service without our consent
• Resell or redistribute the Service or its data without our written permission

6. Subscriptions & Payment

Certain features of Klyp require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date
• Payments are processed through Stripe. By making a purchase, you also agree to Stripe’s Terms of Service

Refund Policy

We offer refunds on a case-by-case basis. If you are unsatisfied with the Service, contact us at contact@sentiments.ch within 14 days of your purchase.

7. Intellectual Property

The Service, including its design, features, AI models, analysis methodologies, code, and content (excluding user-uploaded content), is the intellectual property of Klyp and is protected by copyright, trademark, and other applicable laws.

The insights, scripts, hooks, and recommendations generated by the Service are provided for your personal or business use. You may use AI-generated content in your own videos and marketing materials.

8. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated insights, recommendations, or predictions will be accurate or produce specific results
• Trend data or analytics will result in increased views, engagement, or revenue

9. Limitation of Liability

To the maximum extent permitted by law, Klyp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to Klyp in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Klyp and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third party’s rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 4, 7, 8, 9, 10, and 12) shall survive.

You may delete your account at any time by contacting contact@sentiments.ch.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
